Appeals court strikes down DOMA: Tradition doesn't justify unequal treatment (+video)

A three-judge panel from the federal appeals court in Boston unanimously ruled the Defense of Marriage Act unconstitutional for denying federal benefits to 'same-sex couples lawfully married in Massachusetts.'

The federal appeals court in Boston struck down the Defense of Marriage Act on Thursday, ruling that the federal statute violates the constitutional rights of gay and lesbian married couples to equal treatment under the law.

The action by a unanimous three-judge panel of the First US Circuit Court of Appeals sets the stage for a much-anticipated showdown at the US Supreme Court over same-sex marriage.

Declaring that tradition alone was not enough to justify disparate treatment of same-sex couples, the appeals court said DOMA failed to pass constitutional muster.

?Under current Supreme Court authority, Congress? denial of federal benefits to same-sex couples lawfully married in Massachusetts has not been adequately supported by any permissible federal interest,? Circuit Judge Michael Boudin wrote for the court in a 28-page decision.

Joining the decision were Chief Judge Sandra Lynch and Judge Juan Torruella.

The decision comes three weeks after President Obama announced his support of gay marriage. The Justice Department had initially worked to defend DOMA against the Massachusetts-based legal challenges, but last year announced it would no longer argue for the statute?s constitutionality.

Seven states and the District of Columbia have passed laws recognizing same-sex marriages. More than 30 other states have passed statutes or state constitutional amendments restricting the definition of marriage to between a man and a woman.

The 1996 federal statute seeks to bolster those state efforts to limit the definition of marriage. DOMA defines marriage in an effort to set eligibility for more than 1,100 federal benefits. By declaring that marriage is a union between one man and one woman, Congress intentionally excluded same-sex married couples from receiving the same level of benefits as heterosexual married couples.

For example: gay spouses are barred under DOMA from filing joint tax returns; a surviving spouse in a same-sex marriage may not collect Social Security survivor benefits; and federal employees may not share their government-provided health insurance with a same-sex spouse.

The appeals court noted that federal lawmakers sought to justify DOMA as a means to defend and nurture traditional, heterosexual marriage. The lawmakers also said they wanted to defend traditional notions of morality, and to preserve scarce government resources.

But the court pushed such justifications aside, saying that the offered rationales do not provide adequate support for DOMA.

?DOMA does not ? explain how denying benefits to same-sex couples will reinforce heterosexual marriage,? Judge Boudin wrote.

?This is not merely a matter of poor fit of remedy to perceived problem, but a lack of any demonstrated connection between DOMA?s treatment of same-sex couples and its asserted goal of strengthening the bonds and benefits to society of heterosexual marriage,? the judge said.

In terms of morality, the judge cited the Supreme Court?s 2003 decision striking down a Texas sodomy law. ?Moral disapproval alone cannot justify legislation discriminating on this basis,? Boudin said.

The decision encompasses three different cases consolidated for the appeal. They include: Gill v. OPM (10-2207), Massachusetts v. US Department of HHS (10-2204), and Hara v. OPM (10-2214). The court heard oral argument in early April to examine a July 2010 ruling by a federal judge in Boston who also declared DOMA unconstitutional.

?In reaching our judgment, we do not rely upon the charge that DOMA?s hidden but dominant purpose was hostility to homosexuality,? Boudin wrote. ?The many legislators who supported DOMA acted from a variety of motives, one central and expressed aim being to preserve the heritage of marriage as traditionally defined over centuries of Western civilization.?

Preserving the institution was not the same as ?mere moral disapproval of an excluded group,? the judge said.

?For 150 years, this desire to maintain tradition would alone have been justification enough for almost any statute,? Boudin said. ?But Supreme Court decisions in the last fifty years call for closer scrutiny of government action touching upon minority group interests and of federal action in areas of traditional state concern.?

A team of surface scientists now managed to fix single gold atoms on special sites of an iron-oxide surface. This could open the door to more efficient catalysts, requiring less of the precious material.

Gold Does Not Like to Be Alone

Gold is a noble metal and does not usually bond with other elements, but as a catalyst it facilitates chemical reactions. It can, for example, facilitate the conversion of poisonous carbon monoxide to carbon dioxide. The effectiveness of gold as a catalyst depends on the size of the gold particles. Some evidence suggests that it works best if the gold is present in the form of single atoms. So far, however, this could not be studied in detail. "If individual gold atoms are put on a surface, they usually cluster up, forming nanoparticles", says Gareth Parkinson, who oversaw the experiments in the research group of Professor Ulrike Diebold at the Institute for Applied Physics at the TU Vienna.

Hot Surfaces Loose Atoms

Higher temperatures lead to a higher mobility of the gold atoms, so in order to stop the atoms from clustering, most surfaces must be cooled to a temperature so low that the desired chemical reactions would stop entirely. The researchers at the TU Vienna found a special kind of iron-oxide surface, which locks the single gold atoms in place.

A Good Place to Settle Down

The key to success is a slight deformation of the iron-oxide crystal structure. The oxygen atoms of the topmost layer are not aligned in perfectly straight lines, they are bent into wiggles by the atoms below. At the points where the lines of oxygen atoms are close to each other, the gold atoms attach permanently without losing grip. Even if the surface is heated, the gold atoms stay put only at 500 degrees celsius they start forming clusters.

"When a gold atom hits the iron oxide surface, it diffuses to one of the sites where it can be attached to the surface", says Gareth Parkinson. That way, many single gold atoms can be placed close to each other. When a gold atom hits a position already occupied by another gold atom, however, the two bond and start moving across the surface, picking up additional gold atoms along the way. When they have reached a critical size of at least five atoms, they become immobile again and the miniature gold nugget comes to rest.

New Paths for New Research

Ulrike Diebold expects that the new method will answer important open questions about catalysis. "We have created an ideal model system for probing the chemical reactivity of single atomic species", says Diebold. The recent experiments will also help to advance theoretical research: the quantum mechanically complex bonding between single atoms and this particular surfaces provide an excellent test case for theoretical calculations of highly correlated electron systems.

Bhatia?s team exploited this difference to simultaneously screen compounds for their activity against human cancer stem cells versus normal human stem cells.

By testing hundreds of compounds, they identified nearly 20 potential cancer stem cell specific drugs.

The one that appeared most promising is an antipsychotic drug, thioridazine, which combats the symptoms of schizophrenia by targeting dopamine receptors in the brain. But concerns about side effects of the drug, brand name Mellaril, have meant that far fewer people with schizophrenia are prescribed the drug than newer antipsychotic medications.

Researchers say thioridazine doesn?t appear to kill cancer stem cells, but rather encourages them to differentiate, thus exhausting the pool of self-renewing cells.

Investigators discovered thioridazine kills leukemia stem cells without affecting normal blood stem cells by comparing the proteins in leukemia versus normal blood cells.

Furthermore, leukemia cells, but not normal blood stem cells, express a dopamine receptor on their surfaces. This finding is supported by the discovery of dopamine receptors on some breast cancer stem cells.

?This gives us some explanation,? Bhatia said. It also suggests that dopamine receptors might serve as a biomarker for rare, tumor-initiating cells.

In light of the findings, Bhatia?s team is already planning for a clinical trial of the FDA-approved thioridazine in combination with standard anti-cancer drugs for adult acute myeloid leukemia.

?We?re excited about bringing this drug to patients,? Bhatia said. ?We also hope our platform can now be a pipeline for other cancer stem cells drugs.?

He has hung it on his office wall and uses it for email and other purposes, like being his whiteboard. Microsoft VP Frank Shaw says that such a 80 inch tablet is a device that MS is going to sell. In case you?re wondering, this is not the same 80 inch Sharp Aquos Board touchscreen from CES 2012 in Las Vegas. Shaw said that the model Ballmer has is made by a different company, but it?s running Windows 8. It?s interesting to see that the new OS can run on anything, from smaller devices to huge wall-hanging machines or even smartphones in some cases.

The same MS official said that obviously this 80 inch tablet, like the Microsoft Surface isn?t quite meant for consumers, at least not initially. Sacramento Mayor Kevin Johnson has raised?at least?$841,394 in his re-election bid, according to campaign finance reports.

Both Jones and Padilla have said they do not plan to accept campaign contributions for this race.

Johnson's report showed that his contributions have also outpaced his expenditures.

As of Saturday, the Johnson campaign reported $344,847 in available cash.

If Johnson has any money left over after this campaign, state law allows him to use it for future runs.

Among Johnson's contributors is Ron Burkle, the owner of the Pittsburgh Penguins hockey team, who has expressed interest in purchasing the Sacramento Kings.
